While I do believe this is indeed a case of police misconduct I'm not at all sympathetic to the victim. The matter should have ended after Gates showed the cop his ID from within his home. There is no way the cop found Gates outside; most likely the neighbor caught a glimpse of the cab-driver at the door, as Gates had already gone round the rear of the house for an alternate entrance; by the time the cops arrived the cab and cab driver were long gone so Gates had to have been inside his home, where according to the American constitution he has certain un/in-alienable rights.
